By registering as a driver with Ontario Designated Drivers Inc., you are agreeing to the following terms and conditions:

All of the Terms and Conditions, and the Privacy Policy of Ontario Designated Drivers Inc. apply to you.

You will receive a password and account designation upon completing the Driver registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Ontario Designated Drivers Inc. of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session.Ontario Designated Drivers Inc. cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

You acknowledge, consent and agree that Ontario Designated Drivers Inc.may access, preserve and disclose your account information if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms and Conditions; (c) respond to claims that any Content violates the rights of third parties; (d) respond to your requests for customer service; or (e) protect the rights, property or personal safety of Ontario Designated Drivers Inc., its users and the public.

Ontario Designated Drivers Inc. expressly reserves the right to immediately modify, suspend or terminate Registrant´s account and refuse current or future use of the Service, if Ontario Designated Rivers Inc., in its sole discretion believes Registrant has: (i) violated or tried to violate the rights of others; or (ii) if we become aware of information indicating a safety concern for you, other users of the Service, or the general public, or (iii) acted inconsistently with the spirit or letter of the Terms of Service or these Additional Terms.

You understand that the Service and software embodied within the Service may include security components that permit digital materials to be protected. You may not attempt to override or circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.

All customer names and information, including but not limited to names, addresses, contact information, vehicle information, insurance information and any other thing or matter relating to the customer-driver relationship is the confidential and proprietary information of either Ontario Designated Drivers Inc. or the customer, and you are not permitted to use or disclose it in any matter or at any time except in fulfillment of your contract with the customer.

You are not permitted to provide designated driving services of the type provided to the customers of Ontario Designated Divers Inc. App except through Ontario Designated Drivers Inc.The foregoing prohibition shall apply so long as you are registered as a driver with Ontario Designated Driver Inc., and for a period of two (2) years thereafter.

You are required to confirm that the customers for whom you provide designated driver services have automobile insurance (liability insurance and property damage insurance) coverage in place covering you while providing the driving service or to confirm that your automobile insurance policy covers you while you are providing the driving service.

You are required to obey all applicable laws, including but not limited to posted traffic and safety laws, at all times while performing designated driving services.If we become aware that you have violated traffic or safety laws, or any other laws, while performing designated driving services, we will have the right to immediately terminate you as a registered driver.

You are not to use or disclose, in any manner or to any person any fact, occurrence or information of a personal or confidential nature, or which, if disclosed, would be embarrassing or humiliating, or cause a person to be held in lower esteem by the public of which you become aware while serving as a designated driver unless disclosure of such information is (i) required by law, or (ii) required for you to perform your engagement by a customer.The foregoing restriction shall continue in effect indefinitely, and shall survive the expiration or termination of your status as a registered driver for Ontario Designated Drivers Inc.

Any of the following shall entitle Ontario Designated Drivers Inc. to immediately suspend or terminate (in its sole discretion) your driver registration:

Arrest or conviction of any traffic offense

Any of the following shall entitle Ontario Designated Drivers Inc. to immediately suspend or terminate (in its sole discretion) your driver registration:

• Arrest or conviction of any traffic offense
• Suspension or loss of your driver’s license
• Suspension or loss of your automobile insurance
• Your unrestricted driving privileges
• Conviction of any felony
• Involvement in any automobile accident where you are found to be at fault
• Violation of the Privacy Policy, Terms and Conditions, and/or Driver Terms and Conditions
• And false statement on your driver registration form
• Crimes involving Moral turpitude includes but is not limited to the following: Armed robbery, Assault with a deadly weapon, Attempted Insurance Fraud, Fabricating and Presenting a False Public Claim, False Reporting To Law Enforcement Agency, Falsification of Records to the Court, Forgery, Fraud, Hit & Run, Illegal Sale & Trafficking in Controlled Substances, Indecent Exposure, Kidnapping, Larceny, Mann Act (transportation of women across state lines for the purpose of prostitution), Misleading Sale of Securities in Connection with Transfer of Real Property, Perjury, Possession of Heroin for Sale, Unlawful Sale or Dispensing Narcotic Drugs, Rape, Shoplifting, and Soliciting Prostitution

Except where prohibited by law, you agree to defend, indemnify and hold Ontario Designated Drivers Inc., its employees, agents, contractors, drivers and customers harmless from and against any and all claims, demands, damages, liabilities costs and expenses (including but not limited to court costs, costs of suit and professional fees) arising out of or relating to any breach of the Driver Terms and Conditions.
